An Eviction is the process by which a landlord repossesses the occupation of a leased property from a tenant or occupant through a court order. If a landlord wishes to evict a tenant, he or she must follow strict procedures set forth by the state of Florida.


Common types of Florida Eviction Notifications

 

  • Pay or Quit – A “pay or quit notice” is used in the case where a tenant is behind on his/her rent. It’s a warning that if the tenant does not pay, he/she will be required to vacate the property.

  • Cure or Quit – If the renter violates another term on the lease, a “cure or quit” notice may be issued. This is a warning that the tenant is in violation of the lease. If the tenant does not fix the violation, he/she will be required to vacate the property.

  • Unconditional Quit – In the case of an “unconditional quit”, the tenant is ordered to vacate the property within a specific timeframe. With an unconditional quit, the tenant is not given an opportunity to “fix” any violations or issues.

 


What happens when a tenant refuses to leave after an eviction notice?

The landlord can file an unlawful detainer lawsuit. An unlawful detainer is a lawsuit filed against a tenant that refuses to leave the premises after an eviction notice.
