Foreclosure is a process in which a mortgage company or lien holder terminates all rights of the homeowner to redeem ownership of a home as of result of non-payment or falling delinquent on mortgage payments.  The process of foreclosure in southern Florida begins when a home owner fails to make mortgage payments within the appointed time.  In most cases, the reasons for late payment include divorce, unemployment, medical illness or even death. Regardless of the reasons, typically the goal is to establish a compromise where the lien holder gets paid and the borrower keeps his home (or business).
 
Foreclosure proceedings usually began with a formal request (demand) for payment. This request typically begins with a formal letter issued by the lien holder. This letter of notice is referred to as a Notice of Default (NOD). This notice informs the borrower that it intends to sell the property, terminate all rights of the borrower in that property and evict the borrower from the premises.
